San Diego Sheriff keeping drone use top-secret?




U.S. law enforcement is greatly expanding its use of domestic drones for surveillance. Routine aerial surveillance would profoundly change the character of public life in America. Rules must be put in place to ensure that we can enjoy the benefits of this new technology without bringing us closer to a “surveillance society” in which our every move is monitored, tracked, recorded, and scrutinized by the government. Drone manufacturers are also considering offering police the option of arming these remote-controlled aircraft with (nonlethal for now) weapons like rubber bullets, Tasers, and tear gas. Congress has ordered the Federal Aviation Administration to change airspace rules to make it much easier for police nationwide to use domestic drones, but the law does not include badly needed privacy protections. The ACLU recommends the following safeguards:

USAGE LIMITS: Drones should be deployed by law enforcement only with a warrant, in an emergency, or when there are specific and articulable grounds to believe that the drone will collect evidence relating to a specific criminal act.

DATA RETENTION: Images should be retained only when there is reasonable suspicion that they contain evidence of a crime or are relevant to an ongoing investigation or trial.

POLICY: Usage policy on domestic drones should be decided by the public’s representatives, not by police departments, and the policies should be clear, written, and open to the public.

ABUSE PREVENTION & ACCOUNTABILITY: Use of domestic drones should be subject to open audits and proper oversight to prevent misuse.

WEAPONS: Domestic drones should not be equipped with lethal or non-lethal weapons.

Outrage in India over arrests for Facebook post

NEW DELHI (AP) — As India's financial capital shut down for the weekend funeral of a powerful politician linked to waves of mob violence, a woman posted on Facebook that the closures in Mumbai were "due to fear, not due to respect." A friend of hers hit the "like" button.

For that, both women were arrested.

Analysts and the media are slamming the Maharashtra state government for what they said was a flagrant misuse of the law and an attempt to curb freedom of expression. The arrests were seen as a move by police to prevent any outbreak of violence by supporters of Bal Thackeray, a powerful Hindu fundamentalist politician who died Saturday.

"We are living in a democracy, not a fascist dictatorship," Markandey Katju, a former Supreme Court justice who now heads the Press Council of India, wrote in a protest letter to the chief minister of Maharashtra.

Katju demanded that the state government suspend the police officers who had ordered the arrests and prosecute them.

The women withdrew the comment and apologized, but angry Thackeray supporters ransacked an orthopedic clinic run by the uncle of one woman.

A lawyer representing the women, Sudheer Gupta, said police arrested them Sunday, the day of the funeral, on charges of creating enmity and hatred. They were released on bail Monday.

Shaheen Dhada, the 21-year-old who posted the comment appeared on television Tuesday, her face covered by a scarf so that only her eyes were visible.

Up in smoke: How Gary Johnson and a Colorado marijuana initiative could cost Obama the election





BOULDER, Colorado—Dressed in a sports jacket, a faded peace-symbol T-shirt and blue jeans, the Libertarian presidential candidate Gary Johnson was playing to a rapturous overflow crowd at the University of Colorado. The man who could be the Ralph Nader of 2012 beguiled his largely male, mostly student audience with his views on the second-biggest issue on the Colorado ballot this year: Amendment 64, which would legalize marijuana.

“I’m the only candidate running for president of the United States who wants to end the drug war now,” Johnson, a former Republican governor of New Mexico, said Monday night to cheers. “Colorado has the opportunity to change worldwide drug policy by voting for Issue 64.”

Johnson, who first endorsed marijuana legalization in 1999, is a Ron Paul libertarian with a deep toke of social permissiveness. Even though he was an asterisk in the 2012 Republican presidential primaries, Johnson and his pro-pot stance could be a surprise factor in a swing state where all the polls point to a tie. As Jeff Orrok, the Colorado chairman of the Libertarian Party, puts it, “We’re getting a fair amount of synergy around Amendment 64.”
